Introduction

The following terms and conditions oversee all usage of the deckcheck.co website (herein referred to as the "Website") including all content, services and products accessible via or through the website. The Website is owned and managed by ANTHOS LLC (ANTHOS). The Website is presented for your acceptance devoid of modification of all the terms and conditions contained herein, as well as any other operational rules, policies (inclusive of DeckCheck's Privacy Policy), and procedures that may be occasionally published on this Website by ANTHOS (all together known as the "Agreement"). This Agreement should be read thoroughly before accessing or utilizing the Website. By accessing or using any component of the Website, you agree to be bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access the Website or use any services. If these terms and conditions are perceived as an offer by DeckCheck, acceptance is specifically restricted to these terms. The Website is designed only for individuals who are a minimum of 13 years old.

If you create an account, sign in through a supported account provider, click to accept updated terms, or continue using DeckCheck after updated terms are presented to you, you agree to this Agreement and the Privacy Policy then in effect.

Obligations of site users

ANTHOS hasn't audited, and is not capable of auditing, every piece of content posted on the Website, hence it cannot be accountable for the substance, application, or consequences of such material. By facilitating the Website, ANTHOS neither asserts nor implies endorsement of the posted material, or a belief in the accuracy, utility, or harmlessness of such material. You bear the responsibility to enact necessary protective measures and abide by legal guidelines. The Website might house content that could be viewed as offensive, inappropriate, or objectionable, alongside content harboring technical inaccuracies, typographical errors, and other mistakes. The Website might also accommodate material infringing upon the privacy or publicity rights, or breaching the intellectual property and other proprietary rights, of third parties, or the downloading, copying or usage of which is bound by additional terms and conditions, either expressed or implied. ANTHOS renounces any responsibility for any harm arising from the utilization of the Website by its visitors, or from any content downloaded by these visitors.

Content accessible on external websites

ANTHOS haven't audited, and are not capable of auditing, all of the content accessible via the websites and webpages linked to or from deckcheck.co. ANTHOS does not exert any control over these external websites and webpages, and cannot be held accountable for their content or usage. Linking to a website or webpage that is not a part of ANTHOS doesn't represent or imply an endorsement by ANTHOS of such website or webpage. You are accountable for enacting necessary protective measures and ensuring compliance with all relevant laws. ANTHOS disclaims any responsibility for any harm resulting from your usage of non-ANTHOS websites and webpages.

Copyright violation and DMCA compliance

Just as ANTHOS expects others to respect its intellectual property rights, it upholds the intellectual property rights of others. If you suspect that material situated on or linked by ANTHOS infringes your copyright, you are invited to alert ANTHOS in line with ANTHOS's Digital Millennium Copyright Act ("DMCA") Policy. ANTHOS will act on all such alerts, including when necessary or appropriate, by eliminating the offending material or deactivating all links to the offending material. ANTHOS will cease a visitor’s access to and use of the Website if, under fitting circumstances, the visitor is deemed a recurrent infringer of the copyrights or other intellectual property rights of ANTHOS or others.

Intellectual ownership

This Agreement does not convey any intellectual property from ANTHOS to you, belonging either to ANTHOS or any third party. All rights, titles, and interests in such property will continue to belong (as between the parties) exclusively to ANTHOS. ANTHOS, deckcheck.co, the deckcheck.co logo, and all other trademarks, service marks, graphics, and logos associated with deckcheck.co, or the Website are the trademarks or registered trademarks of ANTHOS or ANTHOS's licensors. Other trademarks, service marks, graphics, and logos linked with the Website might be the trademarks of other third parties. Your usage of the Website does not entitle you or license you to duplicate or otherwise utilize any ANTHOS or third-party trademarks.

DeckCheck's software, interfaces, analysis formats, scoring systems, compiled databases, search indexes, public deck pages, generated insights, trade dress, and non-user-created content are protected by intellectual property and other proprietary rights. Except for the limited rights expressly granted in this Agreement or in written API documentation, no rights are granted to copy, extract, reproduce, cache, mirror, redistribute, sell, sublicense, train on, or create derivative datasets or competing products from DeckCheck content, data, or service output.

Your content

You are prohibited from describing or allocating keywords to your content in a manner that is misleading or illegal, including in a way meant to capitalize on the name or reputation of others. ANTHOS has the right to alter or remove any description or keyword that it deems inappropriate or unlawful, or likely to lead to ANTHOS liability. You must promptly inform ANTHOS of any unauthorized uses of your content, your account, or any other security breaches. ANTHOS will not be held accountable for any actions or non-actions by you, including any damages of any kind incurred as a result of such actions or non-actions.

Deck privacy and scanned public decks

Decklists, decks, notes, edits, and related deck-building information that you create or maintain in DeckCheck's builder are private. DeckCheck does not treat that private builder data as public solely because you created it in your account.

Some DeckCheck features are designed to publish deck information. If you scan a deck, submit a deck through a public deck scan flow, or otherwise use a feature that creates a public deck page (resulting in a /deckview/ URL) or searchable deck record, you understand and agree that the deck information may become public, searchable, indexable, shareable, and accessible through DeckCheck pages, search features, public deck views, and permitted API or integration surfaces.

DeckCheck may provide profile controls, including modes intended to reduce or remove visible association between your username and a public deck. Those controls affect attribution or profile association; they do not make the underlying scanned or published deck completely private. A public, scanned, or published deck may still be visible, searchable, indexed, cached, copied, referenced, or otherwise discovered by other users, search engines, integrations, or third parties.

If you want a deck to remain completely private, do not scan it or submit it through any feature that publishes or makes the deck searchable. You are responsible for deciding whether a deck contains information you are willing to make public before using those features.

Responsibility of contributors

If you comment on material available through the Website (any such material, "Content"), post Content to the Website, post links on the Website, or otherwise generate (or allow any third party to generate) Content, you hold sole responsibility for the content and any damage resulting from it. This holds true irrespective of whether the Content constitutes text, graphics, an audio file, or computer software. By providing Content, you affirm and warrant that:

  • The download, copy, and use of the Content will not violate the proprietary rights, including copyright, patent, trademark, or trade secret rights, of any third party;
  • If your employer has rights to intellectual property you create, you have received permission from your employer to post or make the Content available or secured from your employer a waiver of all rights in or to the Content;
  • You have complied with all third-party licenses relating to the Content and have completed all necessary steps to successfully pass through to end users any required terms;
  • The Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content;
  • The Content is not spam, is not machine- or randomly-generated, and does not contain unethical or unwanted commercial content designed to drive traffic to third-party sites or boost the search engine rankings of third-party sites, or to promote illegal acts (such as phishing) or mislead recipients about the source of the material (such as spoofing);
  • The Content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party.

By providing Content to ANTHOS, you grant ANTHOS a worldwide, royalty-free, and non-exclusive license to reproduce, modify, adapt, and publish the Content solely for displaying, distributing, and promoting your content and ANTHOS. If you delete Content, ANTHOS will make reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be immediately unavailable. Without limiting any of these affirmations or warranties, ANTHOS has the right (though not the obligation) to refuse or remove any content that, in ANTHOS’s reasonable opinion, breaches any ANTHOS policy or is in any way harmful or objectionable, or terminate or deny access to and use of the Website to any individual or entity for any reason, at ANTHOS's sole discretion.

Access

Provided you adhere to these Terms of Service, ANTHOS extends to you a restricted, non-exclusive, non-transferable, non-sublicensable permission to enter and utilize ANTHOS for personal and non-commercial purposes. This permission does not comprise any commercial or resale use of any ANTHOS services or its content; any accumulation and use of any product catalogs, details, or prices; product or user data; any secondary use of ANTHOS or its content; any downloading or duplication of account details for another vendor's benefit; or any use of data scraping, bots, or similar data compilation and extraction instruments. All rights not explicitly bestowed upon you in these Terms of Service are retained and reserved by ANTHOS or its licensors, suppliers, merchants, publishers, rightsholders, or other content suppliers. No ANTHOS service or any portion of ANTHOS may be duplicated, reproduced, copied, sold, resold, visited, or otherwise taken advantage of for any commercial goal without the explicit written approval of ANTHOS. You may not utilize framing techniques to enclose any trademark, logo, or other proprietary details (including images, text, page setup, or form) of ANTHOS without explicit written consent. You may not employ any meta tags or any other "hidden text" using ANTHOS's name or trademarks without the express written approval of ANTHOS. You must not misuse ANTHOS. ANTHOS may only be used as authorized by law. The permissions granted by ANTHOS are revoked if you fail to comply with these Terms of Service.

API and data access

DeckCheck may provide documented API endpoints for limited access to public deck data and related information. Your use of any API, API key, exported data, public deck data, search results, or other DeckCheck service output is limited to the permissions, rate limits, attribution requirements, and use cases described in the applicable API documentation or in a separate written agreement with ANTHOS.

Unless expressly permitted by the API documentation or by written permission from ANTHOS, you may not use DeckCheck data or service output to build, maintain, benchmark, enrich, train, fine-tune, evaluate, or operate a competing product, database, model, search engine, recommendation system, analytics service, or commercial dataset. You may not redistribute, resell, sublicense, bulk download, cache, mirror, or make available DeckCheck data or service output except as expressly allowed by the API documentation or a written agreement.

API keys are confidential and may not be shared, sold, embedded in public client-side code, or used by anyone other than the party to whom they were issued. ANTHOS may revoke, rotate, limit, suspend, or terminate API access at any time, including for suspected abuse, excessive load, security concerns, violation of this Agreement, or use outside the documented API permissions.

Prohibited automated access and data use

You may not access or use DeckCheck through scraping, crawling, spidering, browser automation, bots, scripts, data mining, bulk extraction, automated account creation, reverse engineering, undocumented endpoints, or any other automated method, except where expressly permitted by DeckCheck's public API documentation, robots.txt rules for ordinary search-engine indexing, or written permission from ANTHOS.

You may not bypass or attempt to bypass authentication, rate limits, robots.txt, technical access controls, bot detection, API key requirements, paywalls, account restrictions, or other measures used to protect DeckCheck or its users. You may not interfere with, degrade, overload, probe, scan, test the vulnerability of, or attempt to gain unauthorized access to DeckCheck systems, accounts, data, networks, or infrastructure.

You may not harvest user information, deck data, email addresses, profile data, card price data, analytics, analysis output, or other content from DeckCheck for spam, unsolicited outreach, profiling, surveillance, model training, dataset creation, resale, republication, or any other unauthorized commercial or non-personal use. Public availability of a page does not grant permission to extract or reuse the data on that page outside the permissions in this Agreement.

This section does not prohibit ordinary access by mainstream search engines solely for indexing public pages, provided that such access respects robots.txt, does not create excessive load, does not bypass technical controls, and does not use DeckCheck content or data for prohibited extraction, model training, or commercial dataset creation.

Third-party content and card data

DeckCheck may display or process third-party card names, images, symbols, oracle text, prices, metadata, and other information from sources such as game publishers, card databases, marketplaces, partners, or user submissions. Such third-party materials remain subject to the rights and terms of their respective owners. DeckCheck does not grant you any rights to third-party content beyond what those owners allow.

Some prices, card metadata, and analysis inputs may be incomplete, delayed, inaccurate, or provided by third parties. You are responsible for verifying information before relying on it for purchases, gameplay, tournament decisions, collection valuation, or other important uses.

Payment processing

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Email communications

By creating a DeckCheck account, signing in through a supported account provider, or continuing to use DeckCheck after acknowledging updated terms, you agree that ANTHOS may send you email communications related to DeckCheck. These may include transactional and relationship emails, service announcements, product updates, newsletters, feature announcements, and occasional promotional messages about DeckCheck products, services, partnerships, or offers, where permitted by law.

You may opt out of marketing emails at any time by using the unsubscribe link in those emails. Opting out of marketing emails does not stop transactional or relationship emails that are necessary to operate your account or provide the service, including password resets, account security messages, purchase receipts, legal notices, or important service updates.

You agree that ANTHOS may use third-party email delivery and newsletter management providers to send these communications, manage preferences, process unsubscribes, and handle bounces, complaints, and suppression lists.

Service discontinuation

ANTHOS retains the right to cease, suspend, throttle, restrict, or terminate your access to the entirety or any segment of the Website, accounts, APIs, or service output whenever it deems appropriate, with or without a stated reason, with or without notification, effective immediately. If you desire to terminate this Agreement or your deckcheck.co account (if applicable), you can simply stop using the Website. All elements of this Agreement that are naturally intended to outlast termination shall do so, including but not limited to, ownership stipulations, API and data restrictions, prohibited automated access provisions, warranty renunciations, indemnification, and restrictions on liability.

Warranty disclaimer

The Website is offered on an "as is" basis. ANTHOS, along with its suppliers and licensors, hereby renounce all warranties, be they explicit or implicit, encompassing but not limited to, warranties of saleability, suitability for a specific use, and non-violation. Neither ANTHOS nor its suppliers and licensors guarantee that the Website will be free of errors or that your access to it will be seamless or uninterrupted. You acknowledge that you download from, or otherwise procure content or services from the Website at your discretion and risk.

Restriction of liability

In no situation shall ANTHOS, or its suppliers or licensors, be held accountable in relation to any subject matter of this agreement under any contract, negligence, strict liability or other legal or fair theory for: (i) any unique, incidental, or consequential damages; (ii) the expense of procurement for replacement products or services; (iii) for disruption of use or loss or corruption of data; or (iv) for any sums that surpass the fees paid by you to ANTHOS under this agreement during the twelve (12) month period prior to the cause of action. ANTHOS shall bear no responsibility for any inability or delay due to circumstances beyond their reasonable control. The aforementioned shall not apply to the extent forbidden by relevant law.

Compensation

You consent to compensate and hold harmless ANTHOS, its contractors, and its licensors, as well as their respective directors, officers, employees, and agents from any and all allegations and expenses, including attorneys’ fees, resulting from your usage of the Website, encompassing but not confined to your breach of this Agreement.

Comprehensive assurance and guarantee

You assure and guarantee that (i) your interaction with the Website will strictly adhere to the ANTHOS Privacy Policy, this Agreement, and all relevant laws and regulations (including, but not limited to, any local laws or regulations in your nation, state, city, or other governmental region, concerning online behavior and permissible content, and incorporating all applicable laws regarding the transmission of technical data exported from the United States or the nation in which you live) and (ii) your utilization of the Website will not violate or misappropriate any third party's intellectual property rights.

Modifications

ANTHOS reserves the exclusive right to modify or substitute any portion of this Agreement at its discretion. It is your duty to periodically review this Agreement for modifications. Your ongoing use of or access to the Website following the posting of any modifications to this Agreement signifies acceptance of those modifications. For material changes, ANTHOS may require you to acknowledge the updated Agreement before continuing to use account features. ANTHOS may also, in the future, introduce new services and/or features via the Website (including, the launch of new tools and resources). Such new features and/or services will be governed by the terms and conditions of this Agreement.

Additional provisions

This Agreement embodies the full understanding between ANTHOS and you regarding the subject matter hereof, and it can only be altered by a written amendment endorsed by an authorized executive of ANTHOS, or by ANTHOS's posting of a revised version. Unless otherwise stated by applicable law, this Agreement, and any access to or usage of the Website will be regulated by the laws of the state of Kentucky, U.S.A., excluding its conflict of law provisions, and the appropriate venue for any disputes stemming from or relating to any of the same will be the state and federal courts situated in Franklin County, Kentucky.

Changes to the Terms of Service

We may update our Terms of Service from time to time. We will notify you of any changes by posting the new Terms of Service on this page and updating the "effective date" at the top of this Terms of Service page. You are advised to review the Terms of Service periodically for any changes.
